Terms of Service

Local Zip Pulse lets you create, launch, and manage advertising campaigns across multiple third-party advertising platforms (such as Meta, Google, TikTok, and Snapchat) from a single account, split a budget across those platforms, and send review requests to your customers by SMS or email.

• You must provide accurate information when creating your account and keep it up to date.
• You are responsible for all activity that happens under your account, and for keeping your login credentials secure.
• You must be legally able to enter into a contract, and authorized to act on behalf of the business the account represents.

When you connect or authorize an advertising account, you grant Local Zip Pulse permission to create, manage, and report on campaigns on that account on your behalf, within the budget and settings you configure — including sharing conversion and performance data about your campaigns with the connected advertising platform for reporting, measurement, and optimization purposes. Your use of each connected platform remains subject to that platform's own terms and advertising policies, and we may decline to publish creative or campaigns that violate a platform's policies.

• Subscription fees and ad spend are billed as described at checkout or in your account settings.
• You authorize us to charge your payment method for subscription fees and the ad budgets you set.
• Ad spend is used to purchase advertising on the platforms you connect; we are not responsible for the performance of ads served by third-party platforms.
• Fees are non-refundable except where required by law or expressly stated otherwise.

If you use the review-request feature, you are solely responsible for having the right to contact the customers whose names, phone numbers, or email addresses you upload, and for complying with applicable consumer-messaging laws — including the Telephone Consumer Protection Act (TCPA), CAN-SPAM, and any state-law equivalents — for the SMS and email messages sent on your behalf. You agree to indemnify and hold Local Zip Pulse harmless from any claim arising from contact information you upload or messages sent at your instruction.

Local Zip Pulse and its underlying software, design, and branding are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service for your business's own advertising, subject to these Terms. You retain ownership of the business content and creative you upload; by using the Service, you grant us the rights needed to display, transmit, and submit that content to the advertising platforms you connect, solely to provide the Service.

You agree not to use the Service to:

• Advertise or promote anything illegal, or that violates a connected platform's advertising policies.
• Upload customer contact information you do not have permission to use for messaging.
• Interfere with or disrupt the Service, or attempt to access it in an unauthorized way.
• Misrepresent your identity or your authority to act on behalf of a business.

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you violate these Terms, misuse the Service, or if required to do so by a connected advertising platform. Charges already incurred before termination remain due.

The Service is provided “as is,” without warranties of any kind. We do not guarantee any particular advertising results, and we are not responsible for the availability, policies, or performance of third-party advertising platforms the Service connects to.

To the maximum extent permitted by law, Local Zip Pulse will not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us in subscription fees in the three months before the claim arose.

These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought in the state or federal courts located in Arizona, and you consent to that jurisdiction.

• These Terms, together with our Privacy Policy, are the entire agreement between you and Local Zip Pulse regarding the Service.
• If any provision of these Terms is found unenforceable, the rest remain in effect.
• Our failure to enforce a provision is not a waiver of our right to do so later.
• You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.

We may update these Terms from time to time. If we make material changes, we will update the effective date above and, where appropriate, notify you directly. Continued use of the Service after a change means you accept the updated Terms.
